Mr. Musick joined the firm in 2006 after serving several years as a Special Agent with the United States Secret Service, New York Field Office, where he investigated financial crimes. Since joining the firm he has concentrated his practice in the following areas: Consumer Financial Services, Civil and Commercial Litigation, Constitutional Law and Civil Rights, and Local Government and Public Officials.

  • Bradford v. HSBC Mortgage Corporation, 2011 U.S. Dist. LEXIS 80950 (E.D.Va. 2011). Successfully defended a national mortgage lender for alleged violations of the Truth in Lending Act and the Fair Debt Collection Practices Act.
  • Landes v. Cavalry Portfolio Services, LLC, 2011 U.S. Dist. LEXIS 35467 (E.D. Va. 2011). Obtained dismissal with prejudice of a Fair Debt Collection Practices Act class action complaint involving 91,000 potential class members. 
  • Katz v. Allied Interstate et al., 2010 U.S. Dist. LEXIS 25579 (E.D.Va. 2010). Successfully defended a national collection agency for alleged violations of the FDCPA and various state claims. ACA International’s Map bulletin newsletter lists this case as one of the top four Big Wins-Call Volume Cases in its 2010 Year in Review.
  • Ruiz v. E*Trade Bank et al., 2009 U.S. Dist. LEXIS 115455 (E.D.Va. 2009). Awarded summary judgment dismissing claims alleging violations of the Fair Debt Collection Practices Act and the Equal Credit Opportunity Act.
  • Barrigan v. Decision One, 2009 U.S. Dist. LEXIS 1105 (E.D.Va. 2009) aff’d 353 Fed. Appx. 813 (4th Cir. 2009). Successfully defended national mortgage lender in District Court and on appeal to the Fourth Circuit Court of Appeals.
  • Schmidt v. Household Finance Corporation, 276 Va. 108, 661 S.E.2d 834 (2008). Successfully defended a national mortgage lender in the trial court and on appeal to the Supreme Court of Virginia in a suit alleging violations of the Virginia Consumer Protection Act, Truth in Lending Act, and the Real Estate Settlement Procedures Act.
  • Regularly defends lawsuits filed in the United States District Courts for the Eastern and Western Districts of Virginia and has numerous published opinions in his favor.
  • Represents clients in regulatory matters before the State Corporation Commission.
  • Defends collection agencies in lawsuits filed in state and federal courts and give compliance advice for both state and federal consumer protection laws.
  • Advises clients on compliance with numerous Virginia consumer lending laws.
  • Defends lenders, creditors, loan servicers, collectors and others involved in consumer financial services in lawsuits filed under the Truth in Lending Act, Real Estate Settlement Procedures Act, Fair Credit Reporting Act, and the Fair Debt Collection Practices Act and other related statutes.
