Mr. Gibney is a shareholder in ThompsonMcMullan. His practice includes representation of businesses, local governments, constitutional officers, and private individuals in a broad variety of matters. His areas of practice include litigation, employment law, constitutional issues, professional licensure, zoning and land use, and local government law. He frequently practices in both federal and state court.
Mr. Gibney has represented litigants across Virginia in cases involving issues as diverse as civil rights, wrongful death, commercial claims, excessive force by law enforcement officers, defamation, breach of contract, personal injury, land use, business torts, discrimination of all sorts, criminal indictments, and employee grievances. He has been counsel in over 70 cases in the United States Court of Appeals, and in 15 cases before the Supreme Court of Virginia.
Many local governments call on him for advice and assistance. He frequently conducts seminars for local governments and constitutional officers on topics including employment law, personal and governmental liability, and law enforcement issues. He was selected by his peers as one of the Best Lawyers in America in local government law.
A native of Coatesville, Pennsylvania, Mr. Gibney graduated from the College of William and Mary in Williamsburg, Virginia in 1973. He received a Bachelor of Arts Degree with honors in English. He then attended the University of Virginia, where he received his law degree in 1976. After graduation, he worked as law clerk to former Chief Justice Harry L. Carrico of the Supreme Court of Virginia, serving for two years. He then worked in private practice and as Assistant Attorney General of Virginia, before joining Shuford, Rubin & Gibney in 1987. He served as a director of Shuford, Rubin & Gibney for sixteen years.
Mr. Gibney performs many civic and bar activities. He has been an instructor in the Virginia State Bar’s professionalism course for new attorneys. He is a member of the Chesterfield Health Care Commission (which operates a publicly owned nursing home), of the Board of Directors of Lawyers Helping Lawyers (a charitable organization for disabled attorneys), and of the Governor’s Substance Abuse Services Advisory Council. He has served on the State Board for Contractors, the Chesterfield County Committee on the Future, and the Virginia State Bar Third District Disciplinary Committee. He has been chairman of the Advisory Panel to United States District Court for the Eastern District of Virginia to recommend the appointment of a United States Magistrate. He also has served on the board of number of other charitable organizations. He is past president of the Chesterfield County Bar Association.
Mr. Gibney is a member of the Virginia State Bar, Virginia Bar Association, American Bar Association, Virginia Trial Lawyers Association, Richmond Bar Association, and Chesterfield Bar Association.
