Creditors’ Rights

Thompson McMullan has significant experience representing secured and unsecured creditors, including landlords and lessors, as well as debtors, in an array of workouts, restructurings, and other arrangements involving both real and personal property. Adam R. Nelson manages the Creditor’s Rights area. We have served as approved counsel to the Resolution Trust Corporation and the Federal Depository Insurance Corporation, as well as financial institutions, in seeking to maximize recoveries. When restructurings or settlements are not possible, we represent our clients in subsequent litigation, post-judgment collection activities, and bankruptcy proceedings, including:

  • seeking relief from the automatic stay;
  • protecting the interests of landlords and lessors in their real and personal property;
  • objecting to discharge;
  • avoiding fraudulent and preferential transfers; and
  • serving on creditors’ committees.
