Sherry A. Fox

Law enforcement members. Adoptive parents. Intended Parents. Gestational Carriers. While a broad variance in the types of individuals served, the theme is constant for Sherry Fox’s clients: “Helping people,” says the New York City native, who joined the firm as a summer associate during her second year in law school and has been here ever since. “I love helping people in whatever capacity I can.”

An accomplished and aggressive litigator who fights battles and conducts legal work on her clients’ behalf in courtrooms and behind closed doors, Sherry has two core areas of practice: representing constitutional officers in cases involving arrests, searches, use of force and other constitutional claims; and helping people who desire to grow their families through adoption or surrogacy.

Her representation of constitutional officers — including sheriffs, deputies, and jail officers — includes defense of claims arising under the U.S. Constitution, including the 1st, 4th, 8thand 14thAmendments. She also represents clients before the Equal Employment Opportunity Commission and in federal courts in discrimination matters arising under the ADA and Title VII. “I deeply respect the work my clients are doing and enjoy the people side of it,” she says. “I find the law and facts of these cases really interesting and exciting.”

There’s also a more personal side to Sherry’s caseload, representing individuals and couples building their families through adoption or surrogacy. As a legal assistant for an adoption attorney during college, she learned quickly that she enjoyed the work – and the people. “Adoption and surrogacy cases afford me an intimate level of contact with clients and is work that can truly change a person or a couple’s life,” says Sherry. “It’s a part of my practice that gives me a great deal of personal satisfaction.”

As a successful litigator, the firm also calls on Sherry in cases involving individuals and companies in breach of contract, business disputes, and consumer law-related cases. Her goal for all these clients: Recover money owed. “And,” she adds, “we are very good at it.”

Hailing from Queens, New York, Sherry has a passion for food, her two children, and staying active. The Foxes enthusiastically support community-farm initiatives and love to discover new cuisines and restaurants wherever they go.

  • Surrogacy and Reproductive Law
    • Represents both intended parents and gestational carriers in the drafting, negotiation, and finalization of gestational carrier agreements; post-birth legal proceedings; and reviews of insurance coverage
    • Represents donors in the drafting, negotiation and finalization of donor agreements
  • Adoption
    • Represents adoptive parents and adoption agencies in adoption proceedings, from termination of parental rights through finalization
    • Represents and counsel birth parents in the parental rights termination process
    • Successfully represented adoption agencies in contested adoption proceedings
  • Litigation
    • Representing local jails and law enforcement in cases concerning conditions of confinement and availability of protected rights while incarcerated, such as right to marry or religious freedom
    • Successfully represented law enforcement in cases involving use of force
    • Successfully represented law enforcement in cases alleging constitutional violations
    • Successfully defended constitutional officers against former employee in lawsuits alleging claims of racial discrimination and disability discrimination
    • Successfully represented a sheriff and several deputy sheriffs in defense of an action based upon gross negligence and willful and wanton negligence arising out of a search
