Recent Developments Affecting the Debt Collection Industry

On September 19, 2012, Bert Musick and Mark Colombell, along with David Anthony from Troutman Sanders, were honored to speak before the Second Annual Meeting of the Virginia Creditors Bar Association regarding recent developments affecting the debt collection industry under the Fair Debt Collection Practices Act, the Fair Credit Reporting Act and the Telephone Consumer Protection Act.  There were almost 70 attorneys in attendance for the presentation which focused on recent developments in case law from all over the country.  They discussed issues such as vicarious liability, the arbitrability of claims and the potential reach of the Consumer Financial Protection Bureau.  The seminar also provided an opportunity to address the questions, comments and concerns of members of the local bar who engage in consumer collection work throughout Virginia.  The questions and concerns raised by the attorneys focused primarily on how responsible and ethical attorneys avoid the potential pitfalls of the Fair Debt Collection Practices Act.  We were very grateful to be invited back to speak at this year’s conference and we look forward to the opportunity to speak before this outstanding bar organization in the future.
