Bob Dybing represents Powhatan County in Successful Zoning Dispute

Powhatan County, represented by Bob Dybing, recently prevailed in a long running zoning dispute filed by a developer, who claimed the County had violated his Fourteenth Amendment rights to due process and equal protection by denying his request to rezone 250 acres of land to residential use. U. S. District Judge Robert Payne granted Powhatan County’s motion for summary judgment in Sowers v. Powhatan County, et al., No. 3:06cv754 (E.D. Va. March 12, 2008), and the Motion for Reconsideration was denied on April 29, 2008.

The case was notable for the unusual amount of briefing required: the Court ordered three complete sequences of briefs to be filed during the course of its consideration of the County’s summary judgment motion.  The developer is expected to appeal.
