Overview
Workplace injuries and deaths are matters of utmost importance. When they occur, they typically result in investigations by either OSHA (Occupational Safety and Health Administration), a federal agency, or VOSH (Virginia Occupational Safety and Health), its Virginia counterpart. In addition, employees can report alleged safety and health issues in the workplace to these agencies. Few firms in Virginia can claim extensive expertise in guiding employers through these investigations, but at ThompsonMcMullan we have decades of experience in this field and maintain in-depth knowledge of the workplace safety regulatory landscape.
On VOSH and OSHA matters, we provide our clients with legal assistance from the outset of an investigation, helping to gather the facts of an incident and analyzing the circumstances surrounding it. We study any relevant documentation, interview key personnel, and advise management throughout the process, including providing representation during any administration hearings and appeals. Crucially, we negotiate with agencies on their findings and any proposed penalties and excel at obtaining settlement agreements that are favorable to our clients.
Our OSHA and VOSH practice includes:
- Representation of companies in investigations to workplace injuries and deaths
- Negotiation with agencies on proposed findings and penalties
- Securing settlement agreements
