Civil liability for Virginia Commonwealth’s Attorneys is often governed by different legal doctrines, including Prosecutorial Immunity, Qualified Immunity, and Sovereign Immunity. Liability can depend on both federal and state law, and can turn on what activity is at stake. This webinar discussed these challenging issues, as well as concerns from failures to prosecute, malicious prosecution, and liability from public statements. Billy addressed liability for employment law issues and activities outside the prosecution function, as well as provided insights into Virginia State Bar complaints, particularly as a venue for grievances against prosecutors.
